Welcome to BayDataInsights.com. By accessing or using our website, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
1. Description of Service
BayDataInsights provides a platform for analysts, researchers, and creators (“Authors”) to publish and sell data reports (“Reports”) to interested buyers (“Users”). Reports may be offered for free or for a fee.
2. User Accounts
To submit or purchase Reports, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
3. Submissions and Pricing
3.1 Report Submission
Authors may submit Reports to be published on the platform. Authors have the option to provide a sample of the Report to prospective buyers.
3.2 Pricing
- Author Control: The Author has the sole right to determine the price of their Report. The final decision regarding the pricing amount lies exclusively with the Author.
- Free vs. Paid: Authors may choose to list their Reports for free or for a specific fee.
3.3 Featured Content
BayDataInsights reserves the right to select specific Reports to be highlighted as “Featured” content. This selection is based on internal criteria determined solely by BayDataInsights.
4. Financial Terms
4.1 Commission Fees
BayDataInsights charges a commission of 15% on every paid access to a Report. This amount is deducted automatically from the gross sale price before the remainder is remitted to the Author.
4.2 Taxes
Authors are responsible for determining and paying any applicable taxes resulting from the sale of their Reports.
5. Liability and Disclaimers
5.1 Content Liability
- Author Liability: Authors bear full and sole liability for the content, accuracy, legality, and integrity of the Reports they submit. By submitting a Report, you warrant that you have all necessary rights to the content and that it does not infringe upon the intellectual property or rights of any third party.
- BayDataInsights Liability: BayDataInsights assumes no liability for Reports submitted by Authors. BayDataInsights takes liability only for Reports that are explicitly tagged as originating in “Collaboration with BayDataInsights.”
5.2 AI-Generated Content and Images
- AI Disclosure: Portions of the visual content, including images used on this site, may be generated by Artificial Intelligence (AI).
- Likeness Disclaimer: Persons depicted in AI-generated images are not real individuals. Any resemblance to actual persons, living or dead, is coincidental.
- Rights Warning: Please be aware that AI-generated images may be subject to complex copyright laws. While we strive for compliance, some images might inadvertently reflect elements of their training data. BayDataInsights disclaims liability regarding potential image rights violations stemming from the underlying models used to generate these images.
6. Intellectual Property
- Your Content: Authors retain ownership of the copyright to their Reports. By submitting a Report, you grant BayDataInsights a non-exclusive, worldwide license to host, display, and sell the Report on your behalf.
- Site Content: All branding, site design, and “Collaboration” reports are the property of BayDataInsights.
7. Termination
We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, without notice, for conduct that we believe violates these Terms of Service or is harmful to other users of the Service, us, or third parties, or for any other reason.
